Terms of Use – DaCaPo

These Terms of Use govern your use of the DaCaPo software provided by Waldman Media AB, organization number 556705-6220, Aschebergsgatan 23A, 411 27 Göteborg, Sweden.

1. Description of the Service

DaCaPo is desktop software for creating, editing, versioning, playing, verifying, and delivering Digital Cinema Packages (DCPs) for cinema use.

2. License Grant

Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to use the Software for the duration of your active license or subscription.

3. Subscription & Payments

DaCaPo is sold as monthly and yearly subscriptions, and selected short-term licenses. Subscriptions renew automatically unless canceled. Payments are processed by Paddle, acting as Merchant of Record.

4. Cancellation

You may cancel your subscription at any time via Paddle. Access continues until the end of the current billing period.

5. Refund Policy

Payments are handled by Paddle as Merchant of Record. Refunds and statutory withdrawal rights are governed by Paddle’s Refund Policy. See our Refund & Cancellation Policy for a summary. Where consumer law applies, you may request a withdrawal refund from Paddle within 14 days of the transaction date.

6. License Restrictions

You may not reverse engineer, decompile, modify, resell, sublicense, or circumvent licensing/security mechanisms.

7. License Enforcement

The Software requires license activation and periodic validation. If a subscription expires or is canceled, access may be limited or disabled.

8. Disclaimer

The Software is provided “as is” without warranties of any kind.

While DaCaPo is designed to create, modify, verify, and process Digital Cinema Packages in accordance with applicable industry standards and specifications, Waldman Media AB does not guarantee that any DCP, KDM, DKDM, or other output will be accepted by or operate correctly with every cinema server, projector, mastering system, or other third-party system.

Users are responsible for verifying DCPs and other deliverables before distribution or exhibition and for maintaining appropriate backups of source media, projects, encryption keys, and other critical data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Waldman Media AB shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of revenue or profit, business interruption, failed delivery, or cancelled or unsuccessful exhibition arising from the use of, or inability to use, the Software.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Governing Law

These Terms are governed by the laws of Sweden.
